XATAMAIL POLICY

Terms of Service

These terms govern participation in the XataMail pilot and use of the service when an account is issued.

Agreement and eligibility

By joining the pilot or using XataMail, you agree to these Terms, our Privacy Policy, and Acceptable Use Policy. You must be at least 13 and legally able to enter this agreement. If you use XataMail for an organization, you represent that you may bind it.

Pilot availability

Joining the waitlist does not guarantee an account, a particular address, launch date, feature, price, or service level. Pilot features may change and the service may be interrupted while we test and improve it.

Your account

You are responsible for accurate account information, safeguarding credentials and recovery methods, and activity under your account. Notify support promptly if you suspect unauthorized access. Usernames are issued at our discretion and may not impersonate others, violate rights, or mislead recipients.

Subscriptions and cancellation

Paid plans, renewal terms, taxes, and introductory pricing will be shown before purchase. You may cancel future renewal through the provided account or support process. Unless required by law or stated at checkout, fees already paid are nonrefundable.

Acceptable use and enforcement

You must follow the Acceptable Use Policy. We may limit, suspend, or terminate access to protect users, infrastructure, deliverability, or legal compliance. Where practical and safe, we will provide notice and an opportunity to address a problem.

Your content

You retain rights in content you send or store. You grant XataMail the limited rights necessary to transmit, store, filter, back up, and otherwise operate the service. You are responsible for having the rights required to use that content.

Service limitations

The pilot is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee uninterrupted delivery, permanent storage, compatibility with every client, or that all unwanted or harmful messages will be detected. Keep independent copies of critical information.

Liability

To the extent permitted by law, XataMail and Xatacom will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or lost business arising from the service. Our aggregate liability will not exceed the amount you paid for XataMail during the 12 months before the event giving rise to the claim.

We may update these Terms as the service develops. Material changes will be posted with a new effective date. Questions may be sent to support@xatamail.com.
